Clarity Terms of Use
The rules for using the Clarity app and its subscriptions
These Terms of Use (the “Terms”) are the agreement between you and us about the Clarity app and the web pages that belong to it. By creating an account or using the app you accept them. If you do not accept them, please do not use Clarity. How we handle your personal data is explained in our Privacy Policy, which is a separate document.
In short
- Clarity is for people aged 13 and over. You sign in with Apple, with Google, or with an e-mail address and a password, and you are responsible for what happens under your account (section 2 and section 3).
- The Free plan costs nothing and shows ads on iPhone and iPad. Plus, Pro and Pro Talk are paid subscriptions bought through the App Store. They renew automatically until you cancel in your Apple ID settings. Apple takes the payment and decides on refunds (section 5).
- AI features can be wrong, and you should not enter sensitive information into them. Practice with AI and Talk with AI ask for your agreement in the app first, and you can withdraw it later (section 6).
- Be respectful to other people. You can report a user, an AI answer or content in Profile > Help & support > Complaints & suggestions, and block a user in Friends. We may remove content or close accounts that break the rules (section 8).
- You can delete your account in the app at any time. Your data is then erased 15 days after your request, and until then you can restore the account by signing in again. Deleting does not cancel an App Store subscription (section 12).
- Nothing in these terms takes away the rights that the law gives you as a consumer (section 13).
- If you got Clarity from the App Store, the terms Apple requires in section 16 also apply.
1 Who we are
Clarity is a language-learning app for iPhone and iPad. It is developed and operated by Ilnar Sirazetdinov (“we”, “us”), the same operator that the Privacy Policy names.
You can reach us at support@myclaritylab.app about anything in these Terms. The Help page explains the most common tasks in the app.
These Terms cover the Clarity app and this website. They do not cover the websites and apps of other companies that Clarity uses or links to (section 10).
2 Who may use Clarity
- You must be at least 13 years old. Clarity is not directed at children and we do not knowingly allow a child under 13 to have an account. If we learn that someone under 13 has an account, we may close it.
- In some countries the age at which you may agree to the processing of your data or to a contract is higher than 13 (up to 16 in some EU member states). There, if you are below that age, you may use Clarity only with the permission of a parent or guardian.
- A subscription is bought with an Apple ID. If you are under the age of majority where you live, buy one only with the permission of the person who holds the Apple ID, or of a parent or guardian.
- You may not use Clarity if the law that applies to you forbids it, or if we have closed your account for breaking these Terms.
We do not ask for your date of birth, so we cannot check your age ourselves. When you create an account with an e-mail address, you tick a box saying that you are at least 13 and accept these Terms and the Privacy Policy. By using Clarity you confirm that you meet these conditions.
3 Your account and its security
You sign in with your Apple or Google account, or with an e-mail address and a password. If you sign up with an e-mail address, we send a one-time code to that address, and you enter it in the app before the account can be used. Your Clarity account is linked to the sign-in you chose.
- Keep your password secret, and keep your Apple or Google account and your devices secure. You are responsible for what happens under your Clarity account. If you think that someone else uses it, write to us at once.
- A code that we e-mail to you is meant only for you: do not pass it on to anyone, not even to someone who says they work for Clarity. A code is valid for a short time and works once. You can change the e-mail address you sign in with, and your password, in Profile > Settings > Manage account; before it changes the login or the password, the app asks for a code that we send to your e-mail address (for a new login, to the new address).
- An account is for one person. Do not sell, rent, share or transfer it.
- Choose a nickname and an avatar that follow the rules in section 8. Other users see them; the Privacy Policy lists exactly what other people can see. Your friend code lets anyone who knows it send you a friend request, so share it only with people you want to connect with. You can switch friend requests off in Profile > Account > Friends (“Nobody can add me”). Your friends also see the name of your plan, your streak and your study time, of which the app reports only the study time; you can switch that off in the same place (“Show my progress to friends”). The same switch also hides from your friends the achievements that our servers record for them (reaching a streak of 10, 50 or 100 days, starting your first paid plan, adding an official catalog dictionary).
- The app has no screen for changing your nickname after the first set-up. If you need it changed, write to us. We may change or remove a nickname or an avatar that breaks these Terms.
4 The app, and how it may change
Clarity offers lessons with dictionaries, a catalogue of official courses and dictionaries, tests, games, streaks, hearts and diamonds, Practice with AI, Talk with AI and friends. What you can use depends on your plan, your device and your internet connection.
- Hearts, diamonds, XP, streaks and achievements are virtual items inside the app. They have no cash value, cannot be exchanged for money, sold or transferred, and are not a means of payment.
- Of what your friends see, only the study time is counted and reported by the app on your device, and we do not check it; your plan comes from our records of your App Store subscription or of a plan that we granted you, and your streak from our own records. All three are for information only, and we do not use them to rank users.
- Limits depend on your plan. For example, the daily number of Practice with AI exercises and the monthly time for Talk with AI differ between plans; the plans screen shows them.
- Some features need a recent version of iOS, an internet connection or a paid plan. For example, Talk with AI is not available on every device. The app tells you when a feature is not available to you.
- We work to keep the app running, but we cannot promise that it will always be available or free of errors and interruptions.
- We may change, add or remove features, change limits, or stop offering the app. If a change significantly reduces what a paid plan gives you, we will tell you in the app or in another suitable way where we reasonably can. Your statutory rights are not affected.
- Files that exist only on your device, such as the audio you add to your own dictionaries and the photos, videos and audio of your tests and courses, are not sent to us and we cannot restore them. Keep your own backups if they matter to you.
5 Subscriptions and purchases
Plans and prices
Clarity has a Free plan and three paid plans: Plus, Pro and Pro Talk. Each paid plan is a subscription that you can buy for one month or for one year. What a plan includes, its price and its length are shown on the plans screen (Profile > Account > Manage subscription) and on the App Store purchase sheet before you confirm. Every paid plan removes ads.
Prices come from the App Store and depend on your country and currency. We do not take payment ourselves: Apple does.
Free trial
When a free trial is offered, the purchase screen says how long it lasts and what you will pay after it. Apple decides whether you are eligible (normally a trial can be used once for each Apple ID within a group of subscriptions). The trial turns into a paid subscription unless you cancel at least 24 hours before it ends. If you upgrade to another plan during a trial, the trial ends and the new plan is charged right away.
Payment and automatic renewal
- Payment is charged to your Apple ID at confirmation of purchase.
- A subscription renews automatically for the same period unless it is cancelled at least 24 hours before the end of the current period.
- Your account is charged for the renewal within 24 hours before the end of the current period, at the price the App Store shows you. If the price changes, Apple tells you and, where the rules require it, asks for your consent before the new price applies to you.
- You can manage or cancel a subscription at any time in your Apple ID account settings (on iPhone and iPad: Settings > your name > Subscriptions; see Apple’s instructions). The same window opens from the app: Profile > Account > Manage subscription, then the Manage subscription link at the bottom of that screen while a subscription is active. Cancel at least 24 hours before the renewal date to avoid the next charge.
- After you cancel, the paid plan keeps working until the end of the period you have already paid for. Deleting your account or removing the app does not cancel the subscription: cancel it in your Apple ID settings. Your data is erased 15 days after you ask to delete your account, whether or not a subscription is running, so cancel the subscription yourself if you do not want Apple to charge you again (section 12).
Changing plan
Apple decides when a change of plan takes effect: normally an upgrade starts at once and a downgrade at the next renewal. The plans screen shows a change that is scheduled.
Refunds
Because Apple takes the payment, Apple, not us, decides on refunds for App Store purchases. To ask for one, go to reportaproblem.apple.com or contact Apple Support. This does not limit any right you have by law, for example a right to withdraw from a purchase where the law gives you one. Apple’s terms for the App Store apply to the purchase itself.
Restore purchases
If you reinstall the app or sign in on a new device, open Profile > Account > Manage subscription and tap Restore (the button at the top of the screen, or the Restore link at the bottom). Use the Apple ID that bought the subscription. If you ask to delete your account, you can restore it within 15 days, whatever your subscription (section 12). A plan that is still running when the account is erased (a paid App Store period that has not ended yet, whether or not you switched off its renewal, or a plan that we granted you) can be restored, for as long as it is still running, if you register again with the same e-mail address; the Privacy Policy says which record we keep for this and when we erase it.
Subscriptions and other purchases are also subject to the Apple Media Services Terms and Conditions.
6 AI features
Practice with AI and Talk with AI use AI models from OpenAI. Practice with AI also uses a voice-synthesis service, Fish Audio, to read single words aloud. The Privacy Policy describes what is sent to them.
What to expect
- AI can be wrong. A verdict on your answer, a hint, a translation, an explanation or a sentence in a conversation may be incorrect, incomplete or unsuitable. Use these features as practice aids, not as the final word on a language, and not as legal, medical, financial or other professional advice.
- Do not enter sensitive or confidential information (such as health details, passwords, payment card or ID numbers) or other people’s personal data into AI features. In Practice with AI the text you type is sent to OpenAI; in Talk with AI your voice and the conversation are.
- A sentence that the AI creates for you may also be copied, without your answers and without any account identifier, into a shared bank of exercises that other learners can receive.
- Limits apply: the daily number of exercises and the monthly time for Talk depend on your plan. Do not try to get around the limits, or to make the AI produce harmful or unlawful content.
- If you use Talk with your own OpenAI key, your agreement with OpenAI applies, and OpenAI charges you for that use, not us.
Your agreement, and how to withdraw it
Before Practice with AI sends your text for the first time, the app shows a window that names OpenAI and lists what is sent and what is not. If you choose “Not now”, nothing is sent and the practice does not start. Talk with AI shows its own consent screen before first use. You can withdraw your agreement at any time: for Practice with AI in Profile > Settings > “AI processing consent”, and for Talk in the Talk settings. What was processed earlier stays with the provider under its own rules.
If an AI answer looks wrong or unsuitable, tell us in Profile > Help & support > Complaints & suggestions (say that it is about an AI answer).
7 Your content
You keep the rights in what you create in Clarity: your nickname and avatar, the words, translations and examples of your own dictionaries, your tests and courses, the text you type into AI features, and the messages you send us.
You give us a free, non-exclusive, worldwide licence to store, process and show this content, but only as far as needed to run Clarity for you: to keep it on our servers, to show it to the people a feature is meant for (for example your friends see your nickname and avatar), and to pass it to the AI and voice providers when you use those features. The licence ends when the content is deleted or your account is erased, except for the copies and records that the Privacy Policy says remain.
You promise that you have the right to use the content you add and that it does not break the law or anyone’s rights. Do not copy dictionaries, texts, audio or images that belong to someone else unless you have permission. Apart from automatic checks of nicknames, we do not review content before it appears; if we find or are told that content breaks these Terms or the law, we may remove it.
8 Conduct, reporting and blocking
Clarity is a place to learn, and other people use it too. There is no tolerance for objectionable content or abusive users on Clarity. You agree not to:
- break the law, or help others to do so;
- harass, threaten, abuse or discriminate against others, or use a nickname, avatar or text that is hateful, sexually explicit, violent or otherwise offensive;
- pretend to be another person or organisation, or share another person’s personal data without permission;
- send spam, or use friend requests to bother others;
- cheat or interfere: use bots, scripts or other automation, exploit bugs, or tamper with hearts, diamonds, streaks, study time, limits, ads or rewards;
- try to get into other accounts or into our servers, probe or overload them, or get around access controls;
- copy, resell or scrape the catalogue or the content of the app at scale, or reverse engineer or decompile the app, except where the law gives you that right;
- use the app, including its AI features, to produce or spread harmful or unlawful content.
Reporting and blocking
To report another user, an AI answer or content in the app, open Profile > Help & support > Complaints & suggestions. You can also report a friend from Profile > Account > Friends, with the Report action on that person’s row. To end a friendship and stop friend requests from a user, block them in Friends; a block lasts until you unblock the person, or until one of the two accounts is erased or reset. We read every complaint.
If you break these Terms or the law, we may, depending on how serious it is, remove content, change a nickname or an avatar, warn you, limit features, or suspend or close your account. We aim to deal with reports as soon as we can, but we cannot promise a time. We are not an emergency service: if someone is in danger, call your local emergency number.
9 Advertising
- Accounts without a paid plan see rewarded video ads on iPhone and iPad. Some are shown after a lesson; others you can choose to watch to earn hearts or diamonds, within daily limits. Every paid plan removes ads.
- Ads are provided by Google AdMob. They belong to advertisers; we do not endorse the advertisers or their products and are not responsible for the content of their ads or for what they offer.
- In the EEA, the UK and Switzerland the app asks for your consent through Google’s consent form before it requests ads. Where that form applies, you can change your choice later in Profile > Settings > “Ad privacy options”, and you can manage tracking permission in the iOS Settings. If you decline, ads may be less relevant or unavailable, and rewards from ads may be unavailable too. The Privacy Policy explains what Google receives.
10 Third-party services
Clarity relies on services of other companies: Apple (Sign in with Apple, the App Store, speech recognition), Google (sign-in and AdMob ads), OpenAI (AI models), Fish Audio (voice synthesis), Supabase (database, sign-in and server functions), Resend (e-mail delivery, including your one-time codes) and Vercel (hosting of this website and our administration tool). Their own terms and privacy policies apply to what they do.
We are not responsible for the services of these companies, for the availability of their servers, or for websites that the app links to.
11 Intellectual property and your licence
The app, its design and software, the Clarity name and icon, and the catalogue (official courses, dictionaries and exercises) belong to us or to our licensors and are protected by copyright and other laws. Some components are open source or licensed by others; their licences are listed in Profile > Settings > Documents > Licenses.
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial language learning, for as long as you follow these Terms. We keep every right that we do not expressly grant. If you got the app from the App Store, section 16 adds to this licence.
We may use feedback and ideas that you send us to improve Clarity, without payment or obligation to you.
If you believe that something in Clarity infringes your copyright or another right, write to support@myclaritylab.app with the details: what it is, where you saw it, and why you hold the rights. We will look into it and remove the content where that is justified.
12 Ending your use
By you
You can stop using Clarity at any time. To delete your account, open Profile > Settings > Manage account > Delete account. The app offers a short optional survey, tells you how long the deletion takes and asks you to type a confirmation word. Deleting is not instant: your account is scheduled for deletion and you are signed out. Your data is erased 15 days after your request, whatever your subscription. Until then the account is hidden from other users and you can restore it by signing in again, in the current version of the app, with the same login and tapping “Restore my account”; once the erasure has started (shortly after the erasure date) it cannot be restored. Tests, courses, audio of your own dictionaries and Talk data that exist only on your phone are erased from it as soon as our servers have accepted your request, and restoring the account does not bring them back. The Privacy Policy explains what is erased, when, and what remains. Deleting your account does not cancel an App Store subscription: if you do not cancel it in your Apple ID settings (section 5), it renews and Apple keeps billing you, also after your data has been erased; the erasure date does not move.
By us
We may suspend or close your account if you break these Terms or the law, if you misuse the app or other users, if the law or a court requires it, or if we stop offering the app. Where we reasonably can, we will tell you why, and in advance. If we close your account although you did not break these Terms, your statutory rights concerning payments for a period you can no longer use are not affected; refunds of App Store payments are handled by Apple (section 5).
Parts of these Terms that by their nature should continue, such as intellectual property, disclaimers and limits of liability, continue after your account ends.
13 Disclaimers and limits of liability
To the extent the law permits, Clarity is provided “as is” and “as available”. We do not promise that you will reach a language level or pass an exam, that the app or the AI features will be free of errors or always available, or that the content of other users or ads is accurate or suitable.
To the extent the law permits, we are not liable for indirect or consequential loss, for lost profit, or for lost data (in particular files that exist only on your device), or for losses caused by third-party services, by ads, or by your breach of these Terms. To the extent the law permits, our total liability to you for claims relating to the app is limited to the amount you paid for the app and its subscriptions in the 12 months before the event that gave rise to the claim. These limits apply only as far as the law that applies to you allows.
14 Changes to these Terms
We may change these Terms, for example when features, plans or the law change. We publish the new text on this page with a new version number and date. If a change is significant, or if the law requires us to tell you or to ask for your agreement, we will do so in the app or in another suitable way before the change applies to you. If you keep using Clarity after the new Terms take effect, you accept them, except where the law requires your express agreement. If you do not accept a change, stop using Clarity and delete your account (section 12).
Changes to subscription prices are made through the App Store, where Apple tells you about them and, where required, asks for your consent.
15 General
- These Terms, the Privacy Policy and, for users of the App Store, section 16 are the whole agreement between you and us about Clarity.
- If a part of these Terms turns out to be invalid or unenforceable, the rest stays in force. If we do not enforce a right straight away, we do not give it up.
- You may not transfer your rights under these Terms to anyone else. We may transfer ours together with the app to a successor.
- The mandatory consumer-protection laws of the country where you live apply to you whatever these Terms say.
- If you have a complaint, write to us first and we will try to resolve it. This does not take away your right to go to a court or to a consumer-protection authority.
- This page is also available in Russian. Both versions are meant to say the same thing; if you notice a difference, tell us.
16 Apple App Store terms
This section applies if you got Clarity from the Apple App Store, on iPhone or iPad. It contains the minimum terms that Apple requires for a licence agreement. It applies in addition to the rest of these Terms and, if there is a conflict, it prevails for the app you got from the App Store. Here “Apple” means Apple and its subsidiaries.
- Acknowledgement. These Terms are between you and us only, not between you and Apple. We, not Apple, are solely responsible for the app and its content.
- Scope of licence. The licence we give you is a non-transferable licence to use the app on Apple-branded products that you own or control, as the Usage Rules in the Apple Media Services Terms and Conditions permit (including any use by other accounts through Family Sharing or volume purchasing, to the extent those rules allow it).
- Maintenance and support. We, not Apple, are solely responsible for providing any maintenance and support for the app. Apple has no obligation to provide any. You can reach our support through the Help page and at support@myclaritylab.app.
- Warranty. We are responsible for any warranty that applies to the app, whether express or implied by law, to the extent it is not effectively disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent the law permits, Apple has no other warranty obligation for the app, and any other claim, loss, liability, damage, cost or expense caused by a failure to conform to a warranty is our responsibility.
- Product claims. We, not Apple, are responsible for dealing with any claim by you or by a third party relating to the app or to your possession or use of it, including claims of product liability, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer-protection, privacy or similar laws.
- Intellectual property claims. If a third party claims that the app, or your possession and use of it, infringes its intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You confirm that you are not located in a country that is subject to a US government embargo or that the US government has designated a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties. You will use the app in line with the export and other laws that apply to you.
- Third-party terms. You must follow the third-party terms that apply when you use the app, for example your mobile data or internet service agreement.
- Questions, complaints and claims. Send them to Ilnar Sirazetdinov, support@myclaritylab.app.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple has the right (and is considered to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
